Terms of use — Kaching Checkout

These terms apply between Jack Reid LLC ("we") and the merchant who installs the Shopify app Kaching Checkout ("you"). By installing the app you agree to them.
1. The service
Kaching Checkout shows your customers offers from your own catalogue after checkout, on the thank-you and order status pages, and in a cart drawer and product page block in your theme, and shows you the results in your Shopify admin. You decide which offers run, at what discount, and you can switch the app off at any time in its settings or by uninstalling it.
2. Plans and billing
The free plan and the paid plans are described in the app and in its Shopify App Store listing. Paid plans are billed by Shopify on your Shopify invoice, including any usage fee per order above the included amount, never more than the cap shown for the plan. Every paid plan starts with a 30-day free trial. You can change or cancel a plan at any time in the app; Shopify's billing terms apply.
3. Your responsibilities
- The products, prices and discounts you offer are yours, as are your store's terms, refunds and taxes.
- If you show a reward in the cart drawer (for example free shipping above an amount), the matching discount must exist in your store.
- You inform your customers about your use of apps such as this one in your own privacy policy.
4. Data processing
For your customers' data you are the controller and we are your processor. We process it only to provide the app to you, as described in our privacy policy, and on your documented instructions given through the app's settings.
- What: order facts (order number, date, total, currency, sales channel, payment method name, shipping country, products and quantities), records of the offers shown and how they were answered, and anonymous daily counts of cart drawer and product page suggestions seen and added. When you use customer rules in a funnel, the customer's tags and order count are read when an offer is chosen and not stored; for "once per customer" we store a keyed one-way code of the customer ID, never the ID itself. We store no customer name, e-mail address, postal address or phone number.
- Why: to choose offers, to show you which orders could get an offer and why not, to report results and to count orders for your plan. We do not sell data and do not use it for any other purpose, except to combine figures from all stores that use the app into anonymous totals (for example how often each kind of offer is accepted) to improve the app. Those totals contain no personal data and do not identify your store or your customers.
- Security: data is sent over encrypted connections (HTTPS) and stored on infrastructure that encrypts it at rest. Access is limited to the people who operate the app.
- Sub-processor: a cloud hosting provider runs our servers and database. You can ask for its name through the contact in section 6. We will tell you before adding or replacing a sub-processor that handles your customers' data.
- Retention and deletion: order and offer records are deleted after 13 months. When you uninstall the app its access tokens are deleted at once and all your store's data within 48 hours of Shopify's shop erasure request. Customer erasure requests sent through Shopify are carried out.
- Incidents: if we become aware of a security incident affecting your data we inform you without undue delay.
5. Availability and liability
We work to keep the app available, but it is provided "as is". If the app cannot compute an offer in time, your customers simply see none and checkout continues normally. To the extent the law allows, our liability is limited to the fees you paid us in the twelve months before the claim.
